services to you, subject to the following Terms of Use (TOU), which may be updated from time to time without notice to you.
MEMA reserves the right to authorize membership to use the MEMA LMS; this authorization may be denied, suspended, and/or revoked for misuse of the system or failure to adhere to these TOU. You agree to provide true, accurate, current, and complete information about yourself as prompted by the LMS registration form; and, (b) maintain and promptly update information about yourself to keep it true, accurate, current, and complete. MEMA and the State of Maryland are not legally responsible for any loss of data or content contained within the MEMA LMS.
You acknowledge and agree that MEMA will periodically send email messages to the address specified by you in your user profile. MEMA will not sell or release your data to any third party.
You acknowledge and agree that the services provided through the MEMA LMS are “AS IS” and that MEMA and the State of Maryland assume no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user communications.
You shall use this application only for purposes directly related to the conduct of official business with MEMA and its affiliates. You shall not violate the rights of any person or entity protected by copyright, trade secret, patent, or other similar laws or regulations. You shall not use this application for any fraudulent or illegal purpose, including, but not limited to, the transmission of obscene or harassing materials. You shall not engage in activities that may cause interference with or disruption to any network, information service, equipment, or user thereof.
You must report any abuse or misuse of this application to MEMA and you shall cooperate fully in any investigation into any such abuse or misuse.
Registration for courses sponsored by or provided through MEMA will only be done through the MEMA LMS. All persons wanting to attend any such course must register through the MEMA LMS; while on-site registrations will be permitted, these will not be entered into the MEMA LMS, and thus will not be available on the user’s transcript. Once registered you are responsible to withdraw from those courses you are not able to attend; failure to do so, resulting in a “no-show” at the course, may cause your access to the MEMA LMS to be suspended, revoked, or withdrawn.
You are responsible for acquiring and safeguarding your own user ID and password used to access this application, and you will not disclose your user ID and password to anyone other than the system administrators. You shall be responsible for any activity attributable to the use of your account whether by you or any other person. You agree to (a) notify MEMA of any unauthorized use of your password or user identification and any other breach of security, and (b) ensure that you exit from your account at the end of each session. MEMA and the State of Maryland cannot and will not be responsible for any loss or damage arising from your failure to comply with this section.
You shall comply with all applicable confidentiality and security requirements as set forth in any applicable acceptable use policies or terms of service implemented through this application directly or by public or private organizations whose information systems are used to communicate with the MEMA LMS, and shall not seek information on other users or attempt to obtain access to, copy, or modify other users’ files without express permission.
You understand and agree that MEMA reserves the right to revise, amend, or modify this Acceptable Use Policy or other policies and agreements at any time in any manner. Notice of any revisions, amendments, or modifications will be posted on this and/or other State sites. You agree that MEMA and the State of Maryland will not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.
Some links on the MEMA LMS lead to sites posted by independent site owners. Because MEMA has no control over these sites, MEMA is not responsible for such sites’ accessibility via the Internet and does not endorse products, services, or information provided by such sites. As such, MEMA and the State of Maryland shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with, use or reliance on any user or other content, goods, or services available on or through any other site. Further, the inclusion of these links does not imply that the other sites have given permission for inclusion of these links, or that there is any relationship between MEMA and the linked sites. Any reference to other companies does not imply any partnership, joint venture, or other legal connection where MEMA or the State of Maryland would be responsible for the actions of their respective owners.
You agree, to the extent permitted by law, to indemnify and hold MEMA and the State of Maryland harmless from any claim or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the services, your connection to the services, or your breach of the TOU.
You may discontinue your participation in and access to the MEMA LMS services at any time. The TOU will continue to apply to all past use of the MEMA LMS services by you, even if you are no longer using them. You acknowledge and agree that MEMA may terminate or block your use of all or part of the services, without prior notice for any reason, including, without limitation, if MEMA believes you have engaged in conduct prohibited by this TOU. You agree that upon termination or discontinuance for any reason, MEMA may delete all information related to you on the services and may bar your access to use of the services.
